1. General Disclaimer

THE SERVICE AND ALL CONTENT, TOOLS, FEATURES, AND MATERIALS AVAILABLE THROUGH IT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. ROLLOUT HEAVEN MAKES NO REPRESENTATIONS OR WARRANTIES REGARDING THE ACCURACY, COMPLETENESS, RELIABILITY, SUITABILITY, OR AVAILABILITY OF THE SERVICE FOR ANY PURPOSE.

2. AI-Generated Content Disclaimer

All AI-generated content (marketing campaigns, social media posts, email copy, press releases, ad copy, hooks, captions, and other generated materials) is provided as a starting point and creative tool only.

AI-generated content may contain factual errors, inaccuracies, outdated information, or unintentional similarities to existing copyrighted or trademarked works.
You are solely responsible for reviewing, editing, fact-checking, and legally vetting all AI-generated content before publishing, distributing, or acting on it.
Rollout Heaven does not guarantee that AI-generated content is original, unique, non-infringing, legally compliant, or suitable for your specific use case.
Rollout Heaven does not guarantee that AI-generated content will comply with the content policies, terms of service, or community guidelines of any third-party platform (including but not limited to Instagram, TikTok, YouTube, Facebook, Twitter/X, Spotify, or Apple Music).
Rollout Heaven is not the author of AI-generated content. Content is produced by third-party AI models (Anthropic Claude) and Rollout Heaven does not control the specific output.
Any claims, damages, or liability arising from your publication or use of AI-generated content are your sole responsibility.

3. No Guarantee of Results

Rollout Heaven does not guarantee any specific outcomes, including but not limited to: increased streams, followers, revenue, playlist placements, media coverage, radio play, record deals, sync placements, or any other music career advancement.
Marketing strategies, templates, outreach lists, and campaign suggestions are informational tools only. Results depend on many factors outside Rollout Heaven's control, including your music quality, market conditions, timing, audience receptivity, and effort.
Any case studies, testimonials, or success stories shared on the platform represent individual results and are not guarantees of future performance.

4. Not a Record Label, Manager, Publisher, or Agent

Rollout Heaven is a software tool. It is not a record label, music publisher, talent manager, booking agent, talent agency, or entertainment attorney.

No fiduciary, agency, partnership, joint venture, or employment relationship is created between you and Rollout Heaven by your use of the Service.
Rollout Heaven does not own, control, license, distribute, or have any rights to your music, masters, compositions, or publishing.
Rollout Heaven does not negotiate contracts, deals, or agreements on your behalf.
Rollout Heaven does not represent you in any capacity to third parties (labels, publishers, distributors, venues, or media).

5. Not Legal, Financial, or Tax Advice

Nothing on the Rollout Heaven platform constitutes legal, financial, tax, or accounting advice.
Information about music industry practices (royalties, publishing, licensing, copyright, PRO registration) is provided for general informational purposes only and may not reflect current law or industry standards.
You should consult a qualified entertainment attorney, accountant, or financial advisor for advice specific to your situation.
Rollout Heaven is not responsible for any decisions you make based on information or tools provided through the Service.

6. PRO & Royalty Registration Disclaimer

Rollout Heaven's backlog registration assistance is an administrative convenience tool only. It helps you organize and prepare registration data.
Rollout Heaven is not a Performance Rights Organization (PRO), mechanical licensing body, or royalty collection society. Rollout Heaven does not collect, hold, distribute, or guarantee any royalty payments.
Rollout Heaven does not guarantee acceptance, processing, or accuracy of registrations submitted to BMI, ASCAP, SESAC, SoundExchange, HFA/MLC, or any other collecting society.
You are solely responsible for verifying the accuracy of all registration data, including but not limited to: song titles, songwriter names, publisher information, songwriter splits/percentages, ISRC codes, ISWC codes, and UPC codes.
Errors in registration data submitted through the platform are your responsibility. Rollout Heaven is not liable for incorrect royalty payments, missed royalties, or registration errors.
Rollout Heaven does not issue, obtain, or manage mechanical licenses, synchronization licenses, master use licenses, or any other music licenses on your behalf.

7. Outreach List & Contact Data Disclaimer

Contact information provided in outreach lists (radio stations, playlist curators, press contacts, media outlets) is compiled from publicly available sources and may become outdated.
Rollout Heaven does not guarantee the accuracy, currency, or completeness of contact data.
You are solely responsible for complying with all applicable laws when contacting individuals or organizations, including CAN-SPAM, GDPR, and any applicable anti-spam or privacy laws.
Rollout Heaven is not responsible for any consequences arising from your outreach activities, including but not limited to: recipient complaints, spam reports, legal action, or reputational harm.

8. Third-Party Services & Integrations

Rollout Heaven integrates with third-party services including Stripe, Anthropic (Claude AI), Resend, Serper, Spotify, and Railway. Your use of those services is subject to their respective terms and privacy policies.
Rollout Heaven is not responsible for the availability, accuracy, security, or practices of any third-party service.
Outages, data loss, or changes in third-party services may affect the availability or functionality of Rollout Heaven features. Rollout Heaven is not liable for such disruptions.

9. Implementer & Affiliate Program Disclaimer

Implementers (affiliates) are independent contractors, not employees or agents of Rollout Heaven.
Rollout Heaven does not guarantee any specific income or commission earnings from the Implementer Program.
Implementers are required to comply with FTC Endorsement Guidelines and must clearly disclose their material connection to Rollout Heaven in all promotional communications.
Rollout Heaven is not responsible for representations, promises, or claims made by individual implementers that are not authorized by Rollout Heaven.

10. Email & Communication Disclaimer

If you use Rollout Heaven's tools to create and send email campaigns, you are the sender under CAN-SPAM and all applicable anti-spam laws.
You are responsible for including a valid physical mailing address, a working unsubscribe mechanism, and honest subject lines in any emails you send using content generated through the Service.
Rollout Heaven is not responsible for any legal consequences arising from emails you send using content generated through the Service.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ROLLOUT HEAVEN AND ITS OPERATORS, OFFICERS, EMPLOYEES, AFFILIATES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO: LOST PROFITS, LOST REVENUE, LOST ROYALTIES, LOST DATA, LOSS OF BUSINESS OPPORTUNITIES, REPUTATIONAL HARM, OR COST OF SUBSTITUTE SERVICES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ANY AND ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO ROLLOUT HEAVEN IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED U.S. DOLLARS (USD $100), WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify, defend, and hold harmless Rollout Heaven and its operators, officers, employees, affiliates, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your publication, distribution, or use of AI-generated content; (c) your Content; (d) your violation of these Disclaimers, our Terms of Service, or any applicable law; (e) your outreach activities using contact data from the Service; (f) errors in registration data you submit through the Service; or (g) your infringement of any third-party intellectual property rights.

13. Severability

If any provision of these Disclaimers is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary so that the remaining provisions will remain in full force and effect.
